Ben Giaretta, Partner

Ben Giaretta is a leading international arbitration specialist and Partner at Fox Williams. He represents clients in high-value commercial disputes across a wide range of sectors, including technology, energy, natural resources, construction, infrastructure, commodities and professional services.

What Ben Does

Ben’s core practice is international commercial arbitration and investment treaty arbitration. He is also highly experienced in related dispute resolution processes, including litigation, mediation, adjudication and expert determination.

He advises on disputes arising from complex contracts in industries such as technology, renewables, mining, shipping, M&A and professional services, acting for clients across Africa, Europe, the Gulf region, the Americas and the Asia-Pacific region.

International Arbitration Expertise

Ben has extensive experience conducting arbitrations under all major institutional and ad hoc rules, including ICC, LCIA, SIAC, HKIAC, UNCITRAL and ICSID. He is regularly instructed as counsel and is also frequently appointed as an arbitrator.

He is a Chartered Arbitrator and Fellow of the Chartered Institute of Arbitrators and has been appointed as arbitrator on more than 30 occasions, including as presiding arbitrator, sole arbitrator, party-nominated arbitrator and emergency arbitrator.

Career Background

Ben trained at Ashurst LLP, where he later became a Partner and spent seven years based in Singapore as Head of Arbitration in Asia. He subsequently served as Head of Dispute Resolution at Fox Williams and now leads the firm’s international arbitration team.

• Represented a Malawian client in an ICC arbitration seated in London against a Mozambican counterparty.
• Advised Stratius Investments Limited in an ICSID arbitration against Hungary under the Energy Charter Treaty.
• Acted for a major petrochemicals company in an SIAC arbitration relating to a project in India.
• Presiding arbitrator in a multi-million-dollar ICC joint venture dispute between US and Indian companies.
• Emergency arbitrator in a technology investment dispute between English and Singaporean parties.
• Advised on disputes arising from LNG, solar power and satellite telecommunications projects.

Leadership and Appointments

Ben holds numerous leadership roles in the arbitration community, including Deputy Chair and Trustee of the Chartered Institute of Arbitrators, Board Member of London International Disputes Week, and Advisory Board Member of the London Chamber of Arbitration and Mediation.

He sits on the panels of arbitrators for many of the world’s leading arbitration institutions, including SIAC, HKIAC, DIAC, KCAB, SCCA, JCAA, LCAM and others.
