The firm provides defence at every stage—from pre-charge advice and police attendance to trial strategy, expert instruction and post-charge representation.
A Question of Consent
Consent is central to the majority of sexual offence prosecutions. For a conviction, the jury must be sure that the defendant did not reasonably believe the complainant consented. Demonstrating a reasonable belief in consent can therefore be a powerful defence strategy.
Because the burden lies with the defendant to establish this belief, Stuart and his team examine every detail of the background, communication, behaviour and context surrounding the allegation. Many successful defences turn on a nuanced and expertly presented consent argument.
Section 28 Youth Justice and Criminal Evidence Act 1999
Section 28 allows complainants to give evidence and cross-examination by video recording at an early stage. This dramatically reduces the time available to build a full defence and may limit the evidence the defence can rely on.
Sutton Defence Lawyers has closely followed the rollout of Section 28 and understands how to mitigate its impact. Early instruction is essential—waiting too long increases the risk of prejudice to the defendant.
Accused of Sexual Misconduct?
Allegations of sexual misconduct can feel overwhelming, isolating and profoundly distressing. Stuart’s published articles, including guidance on legal aid, pre-charge procedure and defence strategy, offer clarity during an otherwise uncertain time.
